Part A: General Provisions

§ 2 Conclusion of Contract

(2) By submitting an order or concluding a membership, the customer makes a binding offer to enter into a contract.

(3) The provider will confirm receipt by email. The contract is concluded upon receipt of this confirmation.

(2) In cases of slight negligence, the provider is only liable for breaches of essential contractual obligations (cardinal obligations). In this case, liability is limited to foreseeable damages typical for this type of contract.

(3) The foregoing limitations of liability shall not apply to claims under the Product Liability Act.

Section 5 Data Protection

(3) Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

Part B: Online shop (sales of goods)

The following provisions apply in addition to Part A for orders placed via the online shop shop.cycling-basti.de .

§ 8 Subject of the contract Shop

(1) The supplier sells individually printed textile products (T-shirts, hoodies and similar items) via the shop using the print-on-demand method.

(2) Production is carried out by the service provider Spreadshirt (Spreadconnect). The products are manufactured individually for the customer only after the order has been received.

§ 9 Prices and shipping costs

(1) Shipping costs are added to the product prices. The amount of the shipping costs will be displayed to the customer during the ordering process before the order is completed.

(2) For deliveries to countries outside the European Union, additional costs may be incurred which are beyond the supplier's control (e.g. customs duties, taxes or bank transfer fees). These costs are borne by the customer.

§ 10 Delivery

(1) The products are individually manufactured by the production partner Spreadshirt and shipped directly to the delivery address specified by the customer.

(2) Delivery usually takes 5 to 10 working days after receipt of payment. In exceptional cases (e.g. high demand, public holidays) the delivery time may be longer.

(3) The customer will receive a shipping confirmation by email with tracking information as soon as the order has been shipped.

(4) If delivery fails due to an incorrect address provided by the customer, the customer shall bear the costs of resending the goods.

§ 11 Retention of title

(2) The warranty period for consumers is two years from receipt of the goods.

(3) Obvious defects (e.g., transport damage, incorrect size, faulty printing) must be reported to the supplier immediately, but no later than 14 days after receipt of the goods, by email to shop@cycling-basti.de. Photos of the defect are helpful and will expedite the processing.
